CLOUD ACT, CLIENT DATA AT RISK

The guarantee Microsoft cannot give you

Today, most of a firm’s client meetings are recorded and transcribed through Microsoft Teams. That data (accounts, forecasts, structuring, payroll) is hosted by a company under US law, and therefore subject to the Cloud Act.

Anton Carniaux, Director of Public and Legal Affairs at Microsoft France, under oath before the French Senate inquiry committee on 10 June 2025, when asked to guarantee that French citizens’ data would never be handed to US authorities.

The Cloud Act overrides data residency

This 2018 US law lets US authorities demand access to data held by any company under US jurisdiction, even when stored in Europe.

EU data residency does not protect you

Keeping data in Europe remains a contractual guarantee. The US legal obligation overrides the technical measure, as Microsoft’s own technical director confirmed.

The risk rises with your mid-cap clients

Is an AI-generated report compatible with the firm’s professional secrecy?

Yes, as long as the processing happens under your control. Chartered accountants are bound by professional secrecy. In an on-premise deployment, the tax returns, forecasts and payroll data discussed in the meeting stay on the firm’s server. On the Cloud plan, they are hosted in France and processed on our own servers with no third-party AI provider, but they pass through Cloudflare, which terminates TLS at the network edge.

Does our clients’ data travel through US servers?

Not with an on-premise deployment, where the recording and the report stay on your server. On the Cloud plan, data is stored and processed in France, but traffic goes through Cloudflare, a US company that terminates TLS, transcription and writing included. The firm’s own server therefore rules out the risk of recording a meeting through a consumer tool hosted by a company under US law: asked under oath before the French Senate on 10 June 2025 whether French citizens’ data would never be handed to US authorities, Microsoft France’s Director of Public and Legal Affairs answered that he could not guarantee it.

Can you keep a defensible record of an audit engagement?

Yes. Every meeting in the engagement, the internal control review, the exchange with audited management, becomes a dated, structured report usable for the working file. Traceable exchanges strengthen your file with no writing effort.

Can Recapro be deployed on the firm’s own server (on-premise)?

Yes. The whole processing runs on a machine installed on your premises, which you administer like your accounting production server. Nothing is sent to an outside service to be transcribed or written.
